ADVERTISING POLICY: All bills to Adverser shall be due and payable when rendered. Balances are not paid 30 days will incur a service charge of 1.5% per month. Adverser agrees to pay all collection costs, including, but not limited to court costs, and attorney's fees. All program and advertising content is subject to approval by Nexus Advertising Group (hereinafter “Nexus Advertising Group”). Although Nexus Advertising Group will try to accommodate “last-minute” copy changes, it is agreed that Nexus Advertising Group is not bound to effect copy changes without receiving two (2) business days prior notice. If for any reason Nexus Advertising Group fails to broadcast Adverser's programs or announcements, Nexus Advertising Group will give “make goods”. Adverser further agrees that he will be billed for a live program even if he does not show up. Adverser shall not have other claims against Nexus Advertising Group for broadcast failures regardless of cause. Adverser shall hold Nexus Advertising Group harmless against all liability for slander, libel. Unfair companion or trade practices, false advertising, infringement of trademarks, trade names, and copyrights, resulting in Adverser's content that is broadcasted. Unless otherwise provided by herein, this agreement may be terminated by either party upon giving the other party fourteen (14) days prior to written notice. If Adverser is terminated, he shall pay Nexus Advertising Group the rate earned in accordance with the rate card on which this agreement is based (short rate), rather than the rate contracted for. This contract shall not be binding until accepted by an authorized representative (sales manager) of Nexus Advertising
